Il y a un compromis culturel dans notre société. Les auteurs qui communiquent leurs créations avec le public reçoivent une protection sur ces œuvres pour une durée de 70 ans après la mort de l'auteur.

En même temps en Allemagne les musées Reiss-Engelhorn ont porté plainte contre Wikimédia et l'utilisation d'un portrait de Richard Wagner datant de 1862. Et ils ont gagné en première instance. En Espagne le Museo Thyssen-Bornemisza réclame les droits d'auteur sur les tableaux des peintres impressionistes flamands du 17ème siècle. En Norvège la municipalité d'Oslo essaye de contrôler l'utilisation des images des sculptures de Gustav Vigeland - déjà domaine public - en appliquant le droit sur les marques.

Les problème sous-jacent c'est une narrative officielle qui dit que les œuvres non-protégés sont des œuvres perdus. C'est tout à fait faux et c'est a des mouvements comme Wikimédia de lancer une autre construction narrative qui démontre la valeur du domaine public et demande leur protection.
